A High Court sitting in Delta State has restrained the Nigeria Police Force (NPF) and the Inspector-General of Police (IGP) from enforcing the tinted glass permit policy nationwide.
The court issued an interim injunction following a suit challenging the legality of the planned nationwide enforcement of the tinted glass permit regime. The order bars the police from stopping, harassing, arresting, or detaining motorists over tinted glass permits pending the determination of the substantive suit.
The judgment comes amid controversy surrounding the police announcement that enforcement of tinted glass permits would resume nationwide. Civil society groups, legal practitioners, and motorists had raised concerns, warning that the policy could lead to harassment and extortion on Nigerian roads.
In its ruling, the court held that maintaining the status quo was necessary to prevent possible abuse of power while the case is being heard. It further restrained the police from collecting fees or implementing any enforcement measures linked to the tinted glass permit during the pendency of the case.
Reacting to the development, legal practitioners described the ruling as a relief to motorists, urging the police to respect the court order and avoid actions that could amount to contempt of court.
Meanwhile, the Nigeria Police Force has maintained that it is studying the court ruling and reiterated its commitment to operating within the confines of the law.
The case has been adjourned to a later date for hearing on the substantive matter.
