ADC STATEMENT ON THE REVOCATION OF BAIL GRANTED TO MALLAM ABUBAKAR MALAMI (SAN)

The African Democratic Congress (ADC) has noted with deep concern the decision of the Economic and Financial Crimes Commission (EFCC) to revoke the bail earlier granted to former Attorney General of the Federation and Minister of Justice, Mallam Abubakar Malami, SAN.

The ADC considers this action troubling and inconsistent with the principles of due process, fairness, and the rule of law, which are fundamental to Nigeria’s democracy. While the party reiterates its commitment to accountability and the fight against corruption, it strongly maintains that such efforts must be carried out within the confines of the law and without any appearance of political bias or intimidation.

Mallam Abubakar Malami, SAN, is a respected legal practitioner and senior member of the bar who has consistently demonstrated willingness to cooperate with lawful investigations. The revocation of his bail, in the absence of clear evidence of bail violation or obstruction of justice, raises serious questions about the motive and timing of the EFCC’s action.

The ADC is particularly concerned that the move could set a dangerous precedent where legal processes are perceived as tools for political vendetta rather than instruments of justice. In a democratic society, the presumption of innocence must be upheld until proven otherwise by a competent court of law.

The party therefore calls on the EFCC to act with restraint, professionalism, and transparency, and to ensure that its actions are guided strictly by law and not by external pressure or political considerations. The ADC also urges relevant authorities to safeguard the independence of Nigeria’s justice system and protect the rights of all citizens, regardless of political affiliation or status.

The African Democratic Congress reaffirms its full support for Mallam Abubakar Malami, SAN, and stands firm in its belief that justice must not only be done but must be seen to be done.

WHAT PROMPTED THE ADC’S STATEMENT

The ADC’s statement was prompted by the EFCC’s decision to revoke Malami’s bail despite:

1. No publicly established violation of bail conditions, such as failure to appear, interference with investigations, or flight risk.

2. Growing concerns about selective enforcement, especially involving former government officials perceived to be politically exposed.

3. The political sensitivity of Malami’s profile, as a former Attorney General and a figure associated with opposition realignments.

4. Wider public anxiety about the use of anti-corruption agencies as instruments of political pressure rather than neutral law enforcement bodies.

5. ADC’s positioning as a party advocating rule of law, due process, and institutional independence.

In essence, the party argues that while corruption must be fought decisively, justice must remain impartial, lawful, and free from political influence.
