The Federal High Court sitting in Abuja has ordered the permanent forfeiture of a multi-billion naira expanse of land earlier approved for the Goodluck Jonathan Legacy Model Housing Estate to the Federal Government.
Justice Mohammed Umar gave the order after granting a motion on notice filed by Osuobeni Akponimisingha, counsel to the Independent Corrupt Practices and Other Related Offences Commission (ICPC). The application was not opposed by the defence counsel, Hassan Liman, SAN.
In his ruling, Justice Umar directed the ICPC, acting on behalf of the Federal Government, to supervise the construction of the estate to completion. The project is expected to deliver 962 housing units as originally proposed.
The judge further ordered that the supervision should be carried out in collaboration with the Federal Mortgage Bank of Nigeria (FMBN), the sole respondent in the case, to ensure that the completed housing units are properly utilised by end users.
Justice Umar specifically ordered the final forfeiture of Plot No. 5, Cadastral Zone D12, Kaba District, Abuja, measuring approximately 122,015.80 square metres and valued at N1,944,375,000.
According to the court, the forfeited property is to be deployed strictly for public interest purposes in line with the original housing objective.
